Terms of Service

These Terms of Service ("Terms") govern your use of buyerawareapp.com and the purchase of BuyerAware vehicle reports (the "Service"). By purchasing a report or using this website, you agree to these Terms. If you do not agree, please do not use the Service.
1. What the Service is — and is not
BuyerAware provides a desk-based informational analysis of a used vehicle listing that you submit. Each report is prepared using publicly available vehicle history, recall, and technical service bulletin data, market pricing data, and general knowledge of common issues for the vehicle's make, model, and year.
The Service is not: a physical or mechanical inspection; an appraisal; a warranty or guarantee of any vehicle's condition, safety, or value; legal, financial, or professional mechanical advice; or a substitute for an independent, in-person pre-purchase inspection by a licensed mechanic, which we strongly recommend before any purchase.
A report cannot identify hidden damage, concealed defects, odometer fraud, or any condition not reflected in publicly available records. You are solely responsible for your purchase decision and for verifying any information in the report.
2. Ordering and delivery
Reports cost $19 each, payable at checkout through our payment processor, Stripe. We aim to deliver your report to the email address you provide at checkout within 24 hours of purchase. Delivery times are a goal, not a guarantee; if we anticipate a delay, we will contact you.
You must provide a valid listing link (or VIN) for a specific used vehicle offered for sale in the United States. We may decline any order and issue a full refund at our discretion (for example, if the listing is removed, illegible, or outside our coverage).
3. Refund policy
- Satisfaction refund: if you believe your report did not tell you anything you didn't already know, email us at hello@buyerawareapp.com within 7 days of delivery and we will refund your purchase in full.
- Car already sold: if the vehicle sells before your report is delivered, you may choose a full refund or a credit toward a future report.
- Non-delivery: if we fail to deliver your report, you receive a full refund automatically.
Refunds are issued to the original payment method, normally within 5–10 business days.
4. Your responsibilities
You agree to submit only listings you are personally considering for purchase, to provide accurate information, and not to resell, republish, or redistribute reports. Reports are prepared for your personal, non-commercial use.
5. Intellectual property
The website, reports, and all content are owned by BuyerAware and protected by applicable intellectual property laws. Your purchase grants you a personal license to use your report for your own vehicle-purchase decision.
6. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, BUYERAWARE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANY REPORT IS COMPLETE, ERROR-FREE, OR THAT ANY VEHICLE IS FIT FOR PURCHASE.
7. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, BUYERAWARE'S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE REPORT GIVING RISE TO THE CLAIM. BUYERAWARE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING COSTS OF VEHICLE REPAIR, LOSS OF USE, OR DIMINISHED VALUE. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
8. Indemnification
You agree to indemnify and hold BuyerAware harmless from claims arising out of your misuse of the Service or violation of these Terms.
9. Governing law and disputes
These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law rules. Before filing any claim, you agree to contact us at hello@buyerawareapp.com and give us 30 days to resolve the issue informally.
10. Changes to these Terms
We may update these Terms from time to time. The effective date above reflects the latest version. Material changes will be posted on this page; continued use of the Service after changes take effect constitutes acceptance.
